unenforceable this will not affect the validity and enforceability of other terms
We may change terms and conditions from time to time and revised terms and conditions will take effect immediately
from time of posting. If the revised terms and conditions are unacceptable to you must cease using app and website
We take no responsibility for, and will not be liable for, POPrewards app being temporarily unavailable for reasons
including, but not limited to, maintenance, updates to our systems or due to technical issues.
Fair and Responsible Use
The POPrewards app is designed for your personal use only. POPrewards app should not be used for commercial use.
The use of POPrewards app and website is at your own risk, you must
Provide correct information during Sign Up and keep your details up to date
Select a robust password and keep your username and password confidential
use it as per applicable laws and agree not to manipulate or misuse POPrewards app and website
Not post any material or content on POPrewards app or Website other than content intended for use
Not try to collect or store any data both personal or non-personal hosted on POPrewards app or related websites
Not engage in conduct, activities or use device, software or routines intended to damage POPrewards app or prevents others
from using POPrewards app or related websites
You must not take any action or indirectly participate in any activities that impose any unreasonable or large
load on our infrastructure
You must not try to exploit any technical deficiencies and gaps in software to either gain more privileges in POPrewards app or obtain
any benefits or rewards offered in POPrewards app that you may not be entitled to under fair use of infrastructure
You are not authorised to sell or transfer any Services, including, but not limited to, Offers, Rewards, Points and Bookings,
available to you via POPrewrads app. You can share Merchants and Offers where allowed in application
Right to refusal
We reserves the right to suspend or terminate your account to POPrewards app and related websites at
any time for any reason, including but not limited to, your breach of any terms and conditions of use
You will not be able to use POPrewards app or any offers/rewards offered via POPrewards
app until your account is reinstated after suspension
You will forfeit and will not be able to use any rewards that you may have accumulated,
offers or services offered via POPrewards app after your account is terminated
We will not be liable for financial or any other loss resulting from normal use,
suspension or termination of your POPrewards app account
Services including and not limited to Offers, Rewards, Bookings, Order Online and
Quotes are provided by participating Merchants. Merchants reserve the right vary,
withdraw or refuse any services offered via POPrewards app and/or related websites
All products are dependent on and subject to the availability of the relevant
Merchant and the availability of the Merchant's staff and opening hours at the relevant time;
Offers and rewards cannot be cancelled or refunded once redeemed.
Distance of the businesses shown in the POPrewards app are based on your current location
(when location services is active), this information might be inaccurate, or incomplete.
Compare the information provided on the device to your surroundings and defer to posted signs to resolve any discrepancies.
Registration and Age of user
You can only use POPrewards app as a registered user. You must provide us with accurate and complete
information at the time of registration
We will only share your information with our Merchants or service providers that help us provide
POPrewards app is not available to users under the age of 18 years. By registering and providing
accurate information you confirm that you are above 18 years of age
You may deactivate your account at any time by contacting us. If you choose to cancel
your account or your account is terminated by us, all your user content may remain on our infrastructure
Any promotions including, but not limited to offers, rewards and notifications offered through POPrewards app
or related websites cannot be transferred, redeemed or refunded for cash or used beyond their respective expiry
dates as noted on the promotion.
You are solely responsible for the security and use of any promotions or rewards and We are not responsible
and will not provide a refund for any loss or damage to those promotions or rewards and have no obligation
to replace them for any reason.
We have no obligation to redeem any promotion or voucher which appear in Our sole discretion to have been tampered with or forged.
Liability and Indemnification
By accepting terms and conditions and using POPrewards app and related websites you agree that you waive and will not
assert any claims or allegations of any nature against us, Merchants, business partners, staff or any parties that
provide services to you via POPrewards application or related websites;
We do not make any warranties or representations regarding the preparation, quality or availability of
the products or that the products supplied by the Merchants are safe or fit for consumption and You agree
to relieve Us from any liability whatsoever in this regard
You agree to indemnify us, our employees, or any parties linked with us that directly or indirectly provide
services to you via POPrewards app and related websites, and their employees of any inaccuracy of Service
or any claims or allegations resulting from your use or exploitation of Services
We will not be liable for any direct, indirect, special, consequential, or any damages of any kind including
but not limited to loss of opportunity, profit, bargain, anticipated savings, reputational damage or data
resulting from use or your reliance on Service offered via POPrewards app or related websites, whether
based on warranty, contract, tort, negligence, in equity or any other legal theory, and whether or not
we knew or should have known of the possibility of such damage
We will not be liable for any direct, indirect, special, consequential or damages of any kind resulting
from your use or reliance on Service due to:
mistakes, errors, defects, bugs, omissions, interruptions, availability, delays, performance issues or any other issues that may allow or prevent you from using our Services
content or accuracy of information, including but not limited to Offers, Rewards, Order Online and Bookings posted on POPrewards app by Merchants or by us on behalf of Merchants
Viruses, trojans horses, malware, spyware which may be transmitted to from or through POPrewards app or related websites

Information we collect
We collect both "Personal" and "Non Personal" Information that help us provide our services to you.
Personal information is defined as information that is personally identifiable and is non public. Personal information that we collect include name, mobile number, email address, date of birth and postcode. This information is used to identify you uniquely as a user and allow you to securely use the platform. This information can be updated through user profile section in application. We collect and accrue points via Quick Scans and Order Online transactions. Record/maintain point history from your transactions, reward details, authorisations when you redeem rewards/offers, your preferences, interests when you save, like, share or add to your favourites. We ensure personalised content is presented to you when you use our platform by collecting and recording your device location when you use our platform. We may not be able to provide our services to you without your personal information.
How we collect information?
Most of the personal information is collected when you Sign Up with POPrewards App. We may ask for personal information to create your unique account for you and provide customised and tailored services to you. We may use this information from your interactions with "Merchants". Merchants are participating businesses that use POP platform (includes POPrewards app, POP business app, websites www.popapp.com.au,www.thepoprewards.com.au and associated pages) and provide services including but not limited to rewards/offers. Personal information will be combined with additional information during your interactions. Interactions include Quick Scan, Order Online, Redeem Offers/Rewards, Use Vouchers, Bookings and Feedbacks. We may record your interaction with us.
Personal information is collected and stored electronically. It may be collected in hard copy form.
Update Personal Information
You can update your personal information anytime from mobile app. You can also contact us and request changes to your personal information or provide your feedback or raise any concerns that you may have with privacy.
How we use your information?
We collect your information to provide personalise and tailored services to you. Your personal information is used to provide a unique account to you that enables you to securely receive and use services, offers/rewards tailored for you. We will use your information to communicate with you, this may include gathering feedback, surveys, conducting market research, direct marketing, maintaining our records, sending personalised and tailored services, Rewards and Offers to you from our Merchants, sending notifications or promotional material and dealing with enquiries from you. We may communicate with you on ongoing basis with news, updates and marketing both internally via app or externally like emails.
We will not intentionally disclose or sell your personal information to unrelated third parties for marketing or conducting surveys.
We may use/disclose your information to our business partners or Merchants to settle disputes or in case of fraudulent use. We may use your information to protect our lawful interests. We may disclose your information if we are legally obligated to disclose this information.
How we protect your information?
We do not store financial information like credit card or bank account details on our system for processing transactions. PayPal transactions are processed through PayPal application interface. We use two factor authentication during sign up or to reset forgotten passwords, two factor authentication provides an extra layer of security.
We will take reasonable measures to protect your personal information however we cannot be responsible and liable for any unintentional breach.
We cannot guarantee or protect financial/personal information that you wish to share with participating Merchants or any third party service providers.
Sharing of personal information
We may exchange your personal information with service providers that may assist us with services like analytics, data mining, printing, legal, accounting, consulting, marketing, research, auditing, archival, delivery, security, investigation, and mailing services. These service providers may be located in Australia and/or other countries. We take steps to ensure that all our service providers use this information only for the purpose for which it is disclosed.
We may disclose your information to protect or interests and to comply with the law, enforce our site policies, or protect our or others’ rights, employees, property, or safety.
We will not sell your information to third parties or marketing agencies.
We are not responsible for privacy policies of our Merchants or any related parties that use or provide service to our platform. We will only share information sufficient for Merchants to conduct their business, however we cannot control how they use your information.
